Terms of Service

Polymash Visibility Labs provides AI-powered tools for podcasters, including but not limited to: AI Visibility Check, Episode Title Optimizer, Episode FAQ Page Generator, Show Description Writer, About Page Optimizer, and Online Mic Test (collectively, the "Service").

The Service uses artificial intelligence and large language models to analyze podcast content you submit and generate optimized outputs. The quality and accuracy of AI-generated content may vary, and you are responsible for reviewing all generated content before publishing.

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Your Content

You retain all ownership rights to the podcast content you submit to the Service, including episode titles, descriptions, show notes, transcripts, brand keywords, and any other material you provide ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive license to process it through our AI tools solely for the purpose of delivering the Service to you.

Generated Content

Content generated by our AI tools based on Your Content ("Generated Content") is yours to use. You may copy, publish, modify, and distribute Generated Content without restriction. We do not claim ownership over Generated Content.

However, because AI-generated content is produced by algorithms processing common language patterns, similar or identical outputs may be generated for other users with similar inputs. We do not guarantee that Generated Content will be unique.

Our Use of Content

We do not use Your Content or Generated Content to train AI models. We do not sell, license, or share Your Content with third parties except as necessary to operate the Service (for example, sending content to AI processing providers as described in our Privacy Policy).

We may use aggregated, anonymized usage statistics (such as the number of titles optimized or average content length) to improve the Service. This data cannot be used to identify you or reconstruct Your Content.

You agree not to use the Service to:

• Submit content that you do not have the right to use or that infringes on the intellectual property rights of others
• Generate content that is defamatory, obscene, fraudulent, or that violates any applicable law
• Attempt to reverse-engineer, decompile, or extract the algorithms or models underlying the Service
• Use automated scripts, bots, or scrapers to access the Service beyond normal use
• Interfere with or disrupt the Service or servers connected to the Service
• Resell, sublicense, or redistribute the Service itself (Generated Content is yours; the tools are not)
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate access for violations of these terms, with or without notice.

Certain features of the Service require a paid subscription. All payments are processed securely by Stripe. By subscribing, you agree to:

• Pay all fees associated with your selected plan at the prices in effect at the time of purchase
• Authorize recurring charges to your payment method for subscription renewals unless you cancel before the renewal date
• Provide accurate and complete billing information

Pricing Changes

We may change subscription pricing at any time. Price changes will not affect your current billing period. We will notify you at least 30 days before any price increase takes effect for your account.

Refunds

Subscription fees are generally non-refundable. If you experience a significant service disruption or believe you were charged in error, contact us at support@polymash.com and we will review your case.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that, your account will revert to free-tier access. Your data will be retained for 90 days after downgrade, during which you can resubscribe to regain access.

The Service uses artificial intelligence to generate content suggestions and optimizations. You acknowledge and agree that:

• AI-generated content is produced algorithmically and may contain errors, inaccuracies, or inappropriate suggestions
• You are solely responsible for reviewing, editing, and approving all Generated Content before publishing or distributing it
• We do not guarantee that Generated Content will improve your search rankings, visibility, or audience growth
• AI outputs may occasionally produce content that is similar to existing copyrighted material, and it is your responsibility to verify originality before use
• The effectiveness of AI optimization depends on many factors outside our control, including search engine algorithm changes and competitive dynamics

The Service, including its design, code, AI models, algorithms, documentation, and branding, is owned by Polymash Design and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

You may not copy, modify, distribute, or create derivative works of the Service itself. This restriction does not apply to Generated Content, which is yours as described in Section 4.

To the maximum extent permitted by law, Polymash Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated results will be accurate, complete, or suitable for any particular purpose
• The Service will meet your specific requirements or expectations
• Any defects in the Service will be corrected within a particular timeframe

You agree to indemnify and hold harmless Polymash Design, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you submit to or publish from the Service.

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We will retain your data for 30 days to allow you to request an export, after which it will be deleted
• Any outstanding fees remain due
• Sections that by their nature should survive termination (including ownership, limitation of liability, indemnification, and governing law) will survive

You may terminate your account at any time by contacting us at support@polymash.com.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. During the beta period, this includes changes to features, pricing, data structures, and available tools.

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of California.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Polymash Design regarding your use of the Service, superseding any prior agreements.
